The 1881 sale to the MK&T was challenged by Texas Attorney General Jim Hogg on the grounds that the MK&T did not have the right to own property in Texas, and a state government decree forfeiting the East Line and Red River's charter was ultimately upheld by the Supreme Court of Texas in 1890, forcing the line into receivership. It would be purchased by a representative of the bondholders in 1892 and resold to the SS&S in 1893.[3]
