The Indian Oil and Gas Act (French: Loi sur le pétrole et le gaz des terres indiennes) is an act of the Parliament of Canada relating to the regulation and management of exploitation oil and gas on "land reserved for the Indians".[1]

Provisions

Royalties awarded to First Nations under the act may be held by the federal government in trust.[2]

The act has four main elements:[3]

  • it legalises royalty rates, which were previously set by ministerial prescription
  • it brought existing oil and gas contracts under the act
  • it allowed for a new set of regulations
  • it required the minister to consult with First Nations people in administering the act.

The act establishes Indian Oil and Gas Canada as a regulator of oil and gas on First Nations land.[4] Certain regulations are administered by provincial regulatory authorities.[5]
