2022年马来西亚联邦宪法修正案

2022年马来西亚联邦宪法修正案（英语：2022 amendment to the Federal Constitution of Malaysia）是于2021年11月3日由马来西亚首相署（法律事务）部长旺朱乃迪提呈至马来西亚国会的修宪动议法案。该法案提议修改《马来西亚联邦宪法》第1条、第160条和第161A条，以便依据由大不列颠及北爱尔兰联合王国（英国）、马来亚联合邦、北婆罗洲、砂拉越和新加坡于1963年签署的《1963年马来西亚协定》的原始内容，恢复沙巴和砂拉越在联邦内的地位。法案最终获国会下议院和上议院通过和最高元首苏丹阿都拉的御准，于2022年1月25日在《联邦宪报》上刊登。^[3]2022年2月11日起正式生效。

修正案内容

联邦宪法第1条

将第1条第2款修正至：

联邦应为—
(a) 马来亚邦州属，即柔佛、吉打、吉兰丹、马六甲、森美兰、彭亨、槟城、霹雳、玻璃市、雪兰莪和登嘉楼；以及
(b) 婆罗洲邦，即沙巴和砂拉越。

The States of the Federation shall be—
(a) the States of Malaya, namely, Johore, Kedah, Kelantan, Malacca, Negeri Sembilan, Pahang, Penang, Perak, Perlis, Selangor and Terengganu; and
(b) the Borneo States, namely, Sabah and Sarawak.

联邦宪法第160条

在第160条第2款新增以下内容：

“马来西亚日”是指1963年9月16日；
"Malaysia Day" means the sixteenth day of September, nineteen hundred and sixty-three;

“联邦”是指根据《1957年马来亚联合邦协定》首次成立的联邦并进一步根据大不列颠及北爱尔兰联合王国、马来亚联合邦、北婆罗洲、砂拉越和新加坡于1963年7月9日缔结的协定所成立的联邦，北婆罗洲和砂拉越殖民地、新加坡和现有的马来亚联合邦各州共组的联邦称为“马来西亚”，并根据其所附的宪法文书被称为沙巴州、砂拉越州和新加坡州，但根据1965年8月7日关于新加坡从马来西亚分离并成为独立的主权国家之协议，新加坡不再是马来西亚的一个州属。
"the Federation" means the Federation that was first established under the Federation of Malaya Agreement 1957 and further pursuant to an Agreement concluded on the ninth day of July, nineteen hundred and sixty-three between the United Kingdom of Great Britain and Northern Ireland, the Federation of Malaya, North Borneo, Sarawak and Singapore, the Federation is called Malaysia with the Colonies of North Borneo and Sarawak and the State of Singapore federated with the existing States of the Federation of Malaya as the States of Sabah, Sarawak and Singapore in accordance with the constitutional instruments annexed thereto but under and by virtue of the Agreement relating to the separation of Singapore from Malaysia as an independent and sovereign State dated seventh day of August, nineteen hundred and sixty-five, Singapore has ceased to be a state of Malaysia.

联邦宪法第161A条

将第161A条第6(a)款修正至：

就砂拉越而言，一位属于州法律特定之土著种族之一的公民是该州的土著；
in relation to Sarawak, a person who is a citizen and belongs to one of the races specified by State law as indigenous to the State;
