O concello ou municipio é, nas súas diversas formas, e baixo diferentes designacións, a estrutura básica de administración local en moitos países do mundo. Con orixes diferentes, consonte ás tradicións locais, os concellos modernos teñen, porén, bastantes puntos de contacto na súa estrutura e competencias.
En xeral, poden distinguirse tres tipos de concellos:
Nalgúns países e nalgunhas subdivisións doutros países (como algúns estados norte-americanos), estes diferentes tipos están separados por lei, constituíndo diferentes unidades administrativas. Noutros, como en Portugal e España, todos os concellos son iguais ante a lei, aínda que por mor da súa poboación ou características estean suxeitos a un distinto trato financeiro, electoral, por exemplo (achegas doutras administracións, número de concelleiros elixibles, estatutos de capitalidade, áreas metropolitanas...).
A lexislación básica das municipalidades españolas é a Lei 7/1985, do 2 de abril, Reguladora das Bases do Réxime Local.[1] Segundo esta, o goberno e a administración do municipio correspóndenlle ao Concello, integrado polo alcalde e polos concelleiros. Estes últimos son elixidos mediante sufraxio universal, igual, libre, directo e secreto, por períodos de 4 anos.[2] O alcalde é elixido polos concelleiros en sesión plenaria, ou directamente polos veciños en certos casos contemplados na lei. Forma parte dunha provincia para todos os propósitos administrativos nacionais. Unha municipalidade contén unha ou máis parroquias.
Os órganos que integran a organización municipal son os seguintes:
A nivel particular, cada un dos concelleiros que integran a xunta de goberno mantén unha serie de competencias municipais propias con respecto á área da súa responsabilidade.
A denominación máis común para o municipio en castelán é o de ayuntamiento. Na comunidade autónoma de Galicia, a municipalidade é chamada concello; en catalán, ajuntament; en eúscaro, udala; e en asturiano conceyos (singular: conceyu).
O municipio é a menor unidade político-administrativa no Brasil, estando baixo das Unidades Federativas (UF ou Estado). Posúe só dous poderes: o Executivo (Prefeitura) e o Lexislativo (Cámara de Vereadores); o xudicial agrupa a varios municipios.[3] Xeralmente un municipio está composto dunha cidade, a súa sede, e veciñanzas rurais. Mais tamén se presenta na forma de varios núcleos urbanos dentro do mesmo territorio municipal. Cando son cidades que se desenvolveron moito e aproximaron a outros municipios, dáse o nome de Rexión metropolitana. En especial acontece coas capitais dos estados.
É o municipio o que coida directamente de varios aspectos prácticos da vida da poboación, como rexistro de inmobles, cometidos públicos menos importantes (rúas), asfaltamento de rúas, fiscalización do tránsito, mais a lexislación do tránsito é federal. Prové tamén o ensino básico nas súas escolas. Mantén postos de saúde para a súa poboación. Controla e fiscaliza o transporte público municipal (taxis, autobuses urbanos). Prové ou fiscaliza a recollida de lixo domiciliario. Controla e fiscaliza as feiras libres.[4]
As subdivisións políticas do municipio (distritos) son órganos sometidos ao poder da prefectura. Pode tamén presentar subprefecturas, descentralizando a administración no día a día. En todo caso, o poder político executivo é exclusivamente do Prefecto, sendo todos os outros auxiliares da súa indicación (cargos de confianza).
O municipio non posúe forza policial armada, mais posúe a guarda municipal, que en xeral non usa armas de fogo.
No Brasil, o deseño dos límites municipais raramente coincide cos límites urbanísticos, naturais ou culturais dunha cidade, atendendo primariamente a intereses políticos de oligarquías locais. Basta tomar como exemplo que a cidade (mancha urbana) do Río de Xaneiro ten extensión territorial totalmente desconexa do municipio de Río de Xaneiro; en canto aquela se expande por outros municipios limítrofes, este inclúe aglomeracións fisicamente separadas, como a Barra da Tixuca. O proceso de emancipación municipal no Brasil sufriu forte revés despois de 1996, ano en que unha lei aprobada no Senado Federal ampliou os requisitos necesarios para a creación de novos municipios.[5][6]
Dende 2013, Brasil posúe 5.570 municipios en 26 Estados máis dúas demarcacións equilvantes: o Distrito Federal de Brasilia e o Distrito Estatal de Fernando de Noronha.[7] O maior municipio do Brasil é Sao Paulo, que posúe 1522,986 km² e unha poboación de 11 451 999 habitantes segundo o censo de 2022.[8]
Os 308 municipios portugueses (autarquías locais) corresponden, en territorio, aos chamados concelhos, que son a subdivisión territorial máis consistente que o país tivo ao longo dos seus 800 anos de historia. Con orixe nas cartas de foral que os reis atribuían a certas terras e aos territorios limítrofes, o tipo de administración dos municipios/concellos foi variando substancialmente ao longo do tempo: fóronse creando uns, extinguindo outros, foron variando as súas competencias e nalgúns o territorio, mais os municipios/concellos permaneceron.[9]
Hoxe, os municipios son rexidos por unha Cámara Municipal, órgano executivo, e teñen unha Asemblea Municipal, que é o órgano deliberativo.[10] A Cámara é o órgano executivo que trata do goberno e dos asuntos correntes do municipio. Consonte a poboación do concello, a cámara municipal pode ser constituída por un número de vereadores impar entre 5 e 17, elixidos por sufragio directo e universal en listas, partidarias ou non. A Asemblea é a institución representativa do municipio, cuxa competencia principal é a fiscalización da actividade da cámara municipal. Parte dos seus membros, en número que varía coa poboación do concello e tamén co número de freguesías, é elixida por sufraxio directo e universal en listas que poden, ou non, ser partidarias, e a outra parte é composta por membros por razón do seu cargo: os presidentes das xuntas de freguesía do concello.[11]
